Terms and Conditions

These Terms and Conditions apply to the use of kariyanaking.com and to all quotes and orders between Kariyana King, Garhshankar, Punjab, India (“we”, “us”) and our customers (“you”). Our website and services are for business customers such as importers, distributors, retailers and food-service buyers. By using this website or placing an order, you agree to these terms.

1. Website information

Product photos, descriptions, pack sizes and other details on this website are for general information. Packaging artwork and specifications can change. The details confirmed in your quote or proforma invoice are the ones that apply to your order. We do not sell online; adding products to the quote list does not create an order.

2. Quotes and orders

• We send prices, minimum order quantities (MOQs) and lead times in a written quote. A quote is valid for the period stated in it.
• An order is confirmed only when we issue a written order confirmation or proforma invoice and you accept it.
• If these terms differ from the terms in your quote, proforma invoice or a signed contract, the quote, proforma invoice or contract takes priority.

3. Prices and payment

• Prices, currency, Incoterms and payment terms are those stated in the quote or proforma invoice.
• Unless agreed otherwise in writing, import duties, taxes, port and clearance charges in the destination country are paid by the buyer.
• We may hold production or shipment until any agreed advance payment is received.

4. Delivery and risk

• Delivery and the transfer of risk follow the Incoterm agreed in the quote or proforma invoice (for example FOB or CIF).
• Lead times and shipping dates are estimates. We will keep you informed of any change, but we are not responsible for delays caused by shipping lines, ports, customs or other events outside our control.
• Shipments include a phytosanitary certificate and a certificate of origin. Other documents your importer needs are available on request.

5. Your responsibilities as importer

You are responsible for meeting the import rules of your country, including any licences, registrations, product approvals and labelling requirements (for example FDA, CFIA, FSANZ or MPI rules), and for customs clearance at destination. Where you supply label artwork or text, you are responsible for its legal compliance in your market.

6. Quality and specifications

Goods will match the specifications agreed in the quote or proforma invoice. Spices, rice, flours and other agricultural products are natural products, so small variations in colour, size, aroma and moisture are normal and are not defects. Samples show typical quality and are not a guarantee that every lot is identical.

7. Inspection, claims and returns

Please inspect goods on arrival. Damage, shortages and quality claims are handled under our Returns, Refunds and Claims Policy.

8. Private label and intellectual property

• For private-label orders, you confirm that you own or have the right to use any brand names, logos and artwork you send us.
• Kariyana King, Yaqoot, Muchh Todh and the content of this website (text, photos, logos and designs) belong to us. You may not copy or use them without our written permission.

9. Limitation of liability

To the extent permitted by law, our total liability for any order is limited to the value of the goods in that order. We are not liable for indirect or consequential losses, such as loss of profit, business or goodwill.

10. Events outside our control

We are not responsible for delay or failure to perform caused by events outside our reasonable control, including natural disasters, crop failures, strikes, government actions, export or import restrictions, port congestion, pandemics and transport disruption.

11. Governing law

These terms are governed by the laws of India. Any dispute will be subject to the jurisdiction of the courts of Punjab, India, unless a signed contract with you says otherwise.
